Terms and Conditions
These General Conditions of Sale are concluded between
on the one hand, the company BABEL, holder of the domain name www.scenesdelin.com, a company in the Dunkirk trade and companies register under number RCS 881012967, whose head office is located at 930 rue de la Blanchisserie Saint Jans Cappel France , represented by the brand Scènes de Lin, publisher of the site www.scenesdelin.com, and hereinafter referred to as “Scènes de Lin”
on the other hand, any natural or legal person visiting, making a purchase on the Site www.scenesdelin.com, and hereinafter referred to as “the Customer”
The following definitions apply in these general conditions of sale according to the meaning indicated below (whether they are used in the singular or in the plural).
“General Conditions of Sale”: designate this document, ie the terms and conditions applying in the relations between Scènes de in and the Client.
“Order”: refers to the Customer’s purchase order for one or more Product (s) made by using the Website.
“Site”: refers to the website accessible at the address www.scenesdelin.com
“Product”: designates a product offered for sale on the Website
“Customer”: means a natural or legal person, consumer and / or professional, who uses the Website and acquires one or more Product (s), for his personal needs, through the website having previously adhered to the General Conditions of Sale.
“Recipient” means the natural person designated by the customer to receive the order.
These conditions express all the obligations of the parties. In this sense, the Customer accepts beforehand and without reservation all the provisions provided for in these general conditions. In case of disagreement with the terms and conditions of the General Conditions of Sale, the Customer must not use the Website.
No general or specific condition appearing in the documents sent or handed over by the Client may be incorporated into these conditions, since these documents would be incompatible with these general conditions.
Scènes de Lin reserves the right to adapt or modify these General Terms and Conditions of Sale at any time and without notice, the adaptations or modifications then being applicable to all orders subsequent to these adaptations or modifications.
In the event of modification, the General Conditions of Sale applicable to the Customer’s order are those which were online, and which the Customer accepted on the day of placing his Order.
These General Conditions of Sale aim to define:
– The contractual relations between Scènes de Lin and the Client
– The conditions applicable to any purchase of products made on the Site www.scenesdelin.com whether the Customer is of French or foreign nationality, or whether he is a professional or a consumer.
Any use of the Website and any ordering of one or more Product (s) through the Website implies outright acceptance of all of the General Conditions of Sale.
Only persons legally capable of entering into contracts concerning the Products offered for sale on the Site may place an Order on the Website. When placing the order, the Customer guarantees to have full legal capacity to adhere to the General Conditions of Sale, to place an Order and to conclude a sale.
These conditions apply throughout the duration of the online publication of the products and services offered by the company Scenes de Lin, holder of the domain name www.scenesdelin.com
6- Acceptance and opposition to the general conditions of sale
6.1. Accessibility of the general conditions of sale
Any Internet user can read the general conditions of sale on the Site www.scenesdelin.com com by clicking on the hypertext link at the bottom of each page of the Site. As the general conditions of sale may be subject to modifications, the applicable conditions are those in force on the Site on the date of the order.
6.2. Legal capacity of the Client
Under the general conditions of sale, a Customer is any legal person or natural person, aged at least 18 years or having the authorization of the authorized person on the date of the validation of his order. The Customer is a consumer or a professional residing in FRANCE or abroad. By paying his order, the Customer acknowledges having full legal capacity to commit to the general conditions of sale.
6.3. Acceptance of the general conditions of sale
The Customer acknowledges having read the general conditions of sale and expressly declares to accept them once he has confirmed his order on the Site. Regarding orders that are not placed online on the Site (email, phone, etc.), the Customer acknowledges having read and expressly declares to accept the general conditions of sale when he receives and does not dispute his order confirmation email . By accepting the general conditions of sale, the Customer accepts without reserve all the stipulations provided for in these said conditions, to the exclusion of all others. The general conditions of sale are those in force on the Site on the date of validation of the order by the Customer.
7- Product characteristics and prices
7.1. Consultation of the characteristics of products and services
Scènes de Lin presents on its Site the products and services as well as their detailed descriptions allowing the Customer to know, before the final order is taken, their essential characteristics. The photographs of the products presented on the Site are as faithful as possible but cannot ensure a perfect similarity with the products offered, in particular as regards the colors.
7.2. Product availability and validity of the offer
The offers of products and services as well as the prices appearing on the Site are valid for the current day. A product that has become unavailable is indicated with the words: “Temporarily unavailable” or “Available in stores” in the event that the products presented on the site are possibly still for sale in physical stores of the Scenes de Lin brand. It is also specified that the simple fact of adding a product to the basket does not constitute validation of an order. In other words, the product may become unavailable between the time of addition to the basket and the validation of the order by the Customer. In the event that the unavailability of the product or service is noted after validation of the payment, Scenes de Lin undertakes to proceed with the cancellation of the order and to inform the customer thereof.
The prices of the products and services presented on the Site are indicated in Euros, all taxes included (TTC). They are applicable during the validation of the order by the Customer and do not include the participation in transport costs, invoiced in addition and indicated on the “Summary” page of the basket before the final validation of the order. Prices inclusive of all taxes are understood to include VAT (Value Added Tax) for products delivered in the European Union. Items subject to VAT are subject to French VAT. Any change in the legal rates of French VAT will be reflected in the price of the products and services presented on the Site, on the date stipulated by the relevant implementing decree.
All prices shown are inclusive of VAT. The total amount of an order is made up of the price of the items and the delivery costs. You can use the following payment methods: VISA and MASTERCARD. If the payment is refused by the authorization center, we will not be able to ship the order.
9- Order confirmation
You will receive a confirmation email as soon as we receive your order. Have the references of this email ready for all correspondence. If you do not receive this confirmation email, contact firstname.lastname@example.org.
10- Right of withdrawal
In accordance with article L121-20 of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of the products to exercise his right of withdrawal, without having to justify reasons, nor to pay penalties with the exception, where applicable, of return costs.
The period of fourteen (14) days runs from receipt of the products: when the period of fourteen (14) days expires on a Saturday, Sunday or a public holiday, it is extended until the next working day. Scènes de Lin recommends that Customers who wish to exercise their right of withdrawal inform Customer Service by email at email@example.com.
11.1 Shipping costs
The delivery costs dedicated to our online sales site have been established according to the volumes and weight of the product according to the current rates of the post office and our carriers.
11.2 Delivery times
Small and medium items are shipped by Colissiomo within 3 weeks of order confirmation, subject to product availability. If one or more items are no longer available without this being indicated in the product sheet, the Customer is notified by email or telephone and Scènes de Lin will refund these items.
Larger items will be dispatched within 4-6 weeks.
Any order placed on the Scènes de Lin online sales site can only be sent to the destinations offered. For any request to send abroad, please contact firstname.lastname@example.org.
12- Product return conditions
The Customer has a legal period of fourteen (14) days from the day of receipt of his order to notify Scènes de Lin of his intention to return the product to us and the reason for this return.
The return of the product (s) is made in their original packaging, intact, in perfect condition for resale, with the indication of the order number to which the products relate.
Regarding returns from abroad, the costs are the responsibility of the customer.
During private sales and sales, returns are the responsibility of the customer.
In the event of exercise of the right of withdrawal, Scènes de Lin is required to reimburse the Customer for the sums he has paid, without penalty, with the exception of shipping costs. The refund is due without delay and at the latest within fourteen (14) days following the date of receipt of the returned products.
If you wish to cancel your order you must contact email@example.com. If your order has been shipped, we will ask you to return the products to us by following the instructions given by email.
15- Modification of your order
If you wish to make changes to your order, modify the delivery address or add products, do not hesitate to contact us by email at firstname.lastname@example.org. If your order has been shipped, the order is no longer editable.
16.1. Transport guarantee
Assuming the risks associated with transport, Scenes de Lin undertakes to deliver the products ordered by the Customer in closed, resistant packaging appropriate to the content and the transport requirements. Any product damaged or lost in transit will be replaced. The transport guarantee is only valid if the Customer or his Recipient has signed the delivery slip or transport receipt presented by the carrier on which he will have taken care to issue precise, dated and signed handwritten reservations. By affixing his signature on the delivery slip or the transport receipt, without making any reservations, the Customer acknowledges that his package was not damaged during transport. In the event of a dispute, the original packaging must be kept until the dispute is resolved. Scenes de Lin advises the Customer or its Recipient to inform Customer Service by email at email@example.com within a maximum period of 72 hours from delivery, after this period no complaint will be taken into account.
16.2. Legal guarantee of conformity
Scenes de Lin undertakes to deliver a product that conforms to the order validated by the Customer and responds to any lack of conformity existing on delivery. This complaint must be justified and accompanied by supporting documents for the damage suffered (photos, etc.). In the event of a lack of conformity, the Customer may request the exclusion of any other compensation or damages: either the replacement of the product, transport costs excluded.
The legal guarantee of conformity only applies to the essential characteristics of the products. The photographs of the products presented on the Site are as faithful as possible but cannot ensure a perfect similarity with the products offered, in particular as regards the colors. Likewise, as the production of Scènes de Lin products is artisanal, we cannot guarantee the exactness of the dimensions.
16.3. The legal guarantee against defects or hidden defects
In accordance with article 1641 and following of the Civil Code, the Customer also benefits from the legal guarantee against hidden defects on the products sold on the Site www.scenesdelin.com. The implementation of the legal guarantee of conformity does not preclude the action in guarantee of hidden defects. Four (4) conditions must be met for the Customer to benefit from this guarantee:
The defect or defect affecting the purchased product is serious
The defect or defect must be concealed;
The defect or defect existed before the purchase even if it appeared later;
It must not be the consequence of improper use of the product.
Finally, to benefit from the guarantee, the Customer must act as quickly as possible, at most two (2) years from the day on which the defect or defect was discovered. If the four (4) conditions are met, the Customer may request the exclusion of any other compensation or damages: either the replacement of the product, or the reimbursement of the product including transport costs.
16.4. Implementation of guarantees
Scenes de Lin undertakes to reimburse or exchange defective products damaged or damaged or not corresponding to the customer’s order.
16.5. Customer Complaint
The implementation of the guarantees must be the subject of a request made by email or by phone to Customer Service by email at firstname.lastname@example.org. The complaint must be justified and accompanied by supporting documents for the damage suffered (photos, etc.). The Customer must also indicate whether he wishes the replacement of the product or its reimbursement. NB: complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the person who takes the trouble to expose the dispute.
16.5.1. Acknowledgment of receipt of the complaint
Upon receipt of the customer’s complaint, Scènes de Lin undertakes to send the Customer an acknowledgment of receipt by e-mail indicating that their complaint has been taken into account.
16.5.2. Customer Compensation / Product Replacement
In the event of a replacement occurring following a complaint from the Customer implementing one of its guarantees, unless the parties have agreed otherwise, the product (s) will be shipped without delay and Customer Service will contact the Customer or its Recipient at the latest 2 working days after the notification of acceptance of support by Scènes de Lin.
Refund of the product resulting from a complaint by the Customer implementing one of its guarantees: A refund without delay and at the latest within fourteen (14) working days following the date of “notification of acceptance of support” will be made . The reimbursement includes: the price of the product (s) that is the subject of the complaint, the transport costs relating to the product (s) on the basis of the invoiced price, the return costs incurred by the Customer on production of a supporting document (invoice, …).
17- Applicable law
The General Conditions of Sale are subject to French law. In the event of disputes, the Customer may make their complaints to Scenes de Lin Customer Service by email at email@example.com in order to seek an amicable solution. In the absence of an amicable agreement between the Parties, the dispute will be submitted to the French courts, which have sole jurisdiction in the matter.
